They adopted a narrow <em>mens rea<\/em> approach with determination of a &#8216;culpable mental state&#8217; in <a href=\"https:\/\/kslegislature.gov\/li\/b2025_26\/statute\/021_000_0000_chapter\/021_052_0000_article\/021_052_0009_section\/021_052_0009_k\/\" data-type=\"link\" data-id=\"https:\/\/kslegislature.gov\/li\/b2025_26\/statute\/021_000_0000_chapter\/021_052_0000_article\/021_052_0009_section\/021_052_0009_k\/\" target=\"_blank\" rel=\"noreferrer noopener\">K.S.A. \u00a7 21-5209<\/a> while the defendant isn&#8217;t permitted to work with their diagnosis in their defense. <\/p>\n\n\n\n<p>\u201cThere is a major limitation on the defendant\u2019s ability to introduce evidence corroborating or showing the existence of a mental disease or defect. Such evidence is only admissible as it specifically relates to the requisite <em>mens rea<\/em> of the offense. Therefore, the defense cannot introduce evidence as to the existence of a mental disease or defect to litigate the defendant\u2019s mental condition in general.\u201d Marc Rosen, Insanity Denied: Abolition of the Insanity Defense in Kansas, 8 KAN. POL&#8217;y 253 (1998).<\/p>\n\n\n\n<p>This evidence might touch on why the offense occurred.&nbsp;<\/p>\n\n\n\n<p>Mental health courts are popping up all over the country as an alternative to get folks into treatment, reduce recidivism and lower incarceration costs. Douglas County has their <a href=\"https:\/\/www.dgcoks.gov\/behavioral-health-court\" data-type=\"link\" data-id=\"https:\/\/www.dgcoks.gov\/behavioral-health-court\" target=\"_blank\" rel=\"noreferrer noopener\">Behavioral Health Court<\/a>, but Shawnee County boasts the 6th largest city in population in Kansas.
